The pair have concluded their nearly 12-year-long marriage.
Following their divorce, Bijou Phillips is seeking spousal support from her former husband, Danny Masterson. This request comes in the wake of Masterson receiving a sentence of 30 years to life in prison during his recent rape retrial.
According to documents obtained by People magazine, the 43-year-old actress filed for divorce from the 47-year-old That ’70s Show actor after almost 12 years of marriage. In her filing, she also requested that the court “terminate its ability to grant support” to Masterson, with whom she shares a 9-year-old daughter named Fianna.
Phillips’ request includes granting Masterson visitation rights in exchange for his full legal and physical custody of Fianna. Notably, there is no mention of a prenuptial agreement in the documents, and she also asked the court to divide their assets as separate property. The reason for their split was cited as “irreconcilable differences,” with the separation date listed as “TBD.”
Additionally, Phillips is requesting that Masterson cover her legal expenses. Her attorney, Peter A. Lauzon, stated, “Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter. This period has been unimaginably hard on the marriage and the family. Mr. Masterson was always present for Ms. Phillips during the most difficult times of her life. Ms. Phillips acknowledges that Mr. Masterson is a wonderful father to their daughter.”
Variety reported that Phillips was present in the courtroom with members of Masterson’s family during the sentencing on September 7. A court sketch depicted Masterson kissing his wife before being led away to prison.
